Thank you for choosing Opal! This Privacy Policy (“the Policy”) describes how Opal and Company, Inc. (“Opal”, “we”, “us” and “our”) collects, uses, processes and shares information that we collect about you, relating to access to and use of Opal’s websites [www.opal.community], applications, product, software, tool, or any other means you may be able to access Opal services (the “Services”). This Policy is a legally binding contract between Opal and you. All activities in which you may engage with the Services are voluntary. If you do not agree with or have any concerns about this Policy, you should not use the Services.

This Policy describes the types of information we may collect from you or that you may provide us and our practices for collecting, using, maintaining, protecting and disclosing such information.

Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Services. By accessing and using the Services, you agree to this Policy.

You can access or register for the Services by registering an account with us (“Account”). The Account can be registered using your account credentials for third party services (each, an "Integrated Service") such as Google or Facebook, or otherwise connect such Integrated Services to your account. By connecting with an Integrated Service, you authorize us to access and store your name, email address, date of birth, gender, current city, profile picture URL, comments, and other information that the Integrated Service makes available to us, and to use and disclose it in accordance with this Policy. You should review your privacy settings on each Integrated Service to understand the information sent to us through each Integrated Service. Please review each Integrated Service's terms of use and privacy policies carefully before using their services and connecting to our Services.

  1. Modifications to this Policy. Opal reserves the right to modify this Policy at any time. If Opal makes changes to the Policy, the updated policy will be posted on the Opal webpage at https://www.opal-app.org/privacy-policy. If Opal makes changes to the Policy, the updated policy will be uploaded to the Services and will be available to you immediately. You will be notified of modifications to the Policy via email, in-app notification, push notification, or other reasonable methods of providing you notice. Continued access to or use of the Services, after the posted effective date, will be subject to the revised Privacy Policy.

  2. Information We Collect or Receive. In the course of operating the Services, we will collect and/or receive the following types of information. You authorize us to collect and/or receive such information.

    (a) Personal Information. We only receive or collect information that identifies you personally if you choose to provide such personally identifiable information to us via email, posting, uploading, or other means to the Services. When you sign up to become a user or contact us, you will be required to provide us with personally identifiable information about yourself (collectively, the “Personal Information”). Such Personal Information may include your name, age, gender, ethnicity, phone number, location, e-mail address, student status, school information, industry type, current employment information, and previous employment information. We do not collect any Personal Information from you when you use the Services unless you provide us with the Personal Information voluntarily.

    (b) Payment Information. If you choose to make a purchase or subscribe to a feature or service ours that requires a fee, you will be required to provide us with your payment information, including, without limitation, bank account numbers, credit card or debit card numbers, account details, ACH information, and similar data (collectively, “Payment Information”). Such Payment Information will be collected and processed by our third-party payment vendors pursuant to the terms and conditions of their privacy policies and terms of use, and we do not obtain access to any Payment Information in connection with such purchases or subscriptions.

    (c) Geolocational Information. Certain features and functionalities of the Services are based on your location. In order to provide these features and functionalities while you are using your mobile device, we may, with your consent, automatically collect geolocational information from your mobile device or wireless carrier and/or certain third-party service providers (collectively, “Geolocational Information”). Collection of such Geolocational Information occurs only when the Services is running on your device. You may decline to allow us to collect such Geolocational Information, in which case we will not be able to provide certain features or functionalities to you.

    (d) Other Information. In addition to the Personal Information, Payment Information, and Geolocational Information, we may automatically collect or receive additional information regarding you and your use of the Services; your interactions with us and our advertising; and information regarding your computer and mobile devices used to access the Services (collectively, the “Other Information”). Such Other Information may include:

    1. Information collected directly from you when you provide it by filling in forms on our Services. This includes information provided at the time of register to access or use our Services or requesting further services. We may also ask you for information when you report a problem with our Services. You also may provide information to be published or displayed on public areas of the Services.

    2. Information collected automatically as you navigate through the Services. Information collected automatically may include usage details, IP addresses information collected through cookies, web beacons or pixels. We may use automatic data collection technologies to collect certain information to help us improve our Services and to deliver a better and more personalized service.

      • To enforce or apply our Terms;

      • If we believe disclosure is necessary or appropriate to protect the rights, property, data security, or safety of Opal, our customers, or others.

  6. How We Protect Your Information. We take commercially reasonable steps to protect the Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties with which we may share such Information, nor can we guarantee that the Information you supply will not be intercepted while being transmitted over the Internet.

    The safety and security of your information also depends on you. Where we have given you or where you have chosen a password for access to parts of the Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

  7. Personal Information Visible to the Public/Other Users. Your User Contributions are posted on, uploaded to, and transmitted to others at your own risk. (In this policy, “User Contributions” refers to your publicly available profile information and all content you may share using the Service we make available to you). Although we may limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom you may choose to share your user contributions.

  8. Information Collected by Or Through Third-Party Advertising Companies. We may share Other Information about your activity on the Services with third parties for ad distribution and ad optimization (defined as the tailoring, targeting (i.e., behavioral, contextual, retargeting, analyzing, managing, reporting, and optimizing of ads). These third parties may use cookies, pixel tags (also called web beacons or clear gifs), and/or other technologies to collect Other Information for such purposes. Pixel tags enable us and these third-party advertising companies to recognize a browser’s cookie when a browser visits the site on which the pixel tag is located in order to learn which advertisement brings a user to a given site. In addition, we may receive Other Information from advertisers and/or their service providers such as advertising identifiers, IP addresses, and post-conversion data.

  9. How to Opt Out Of Third-Party Interest-Based Advertising. Additionally, users of mobile devices can follow the below instructions:

    (a) Android Users. For Android devices with OS 2.2 and up and Google Play Services version 4.0 and up: Open your Google Settings app > Ads > Enable “Opt out of interest-based advertising.”

    (b) iOS Users.

    • iOS 7 or Higher: Go to your Settings > Select Privacy > Select Advertising > Enable the “Limit Ad Tracking” setting.

    • iOS 6: Go to your Settings >Select General > Select About > Select Advertising > Enable the “Limit Ads Tracking” setting.

  10. Links to Other Web Services. This Policy applies only to the Services and not to any third-party links, products, services, or businesses found on our Services.

    The Services may also contain links to web services that are not operated by Opal or its affiliates. These links are provided for your reference and convenience only and do not imply any endorsement of the products sold or information provided through these web services, nor any association with their operators. Opal does not control these web services and is not responsible for their data practices. Any information you provide to third parties on their web services is covered under their privacy and data collection policies and is not covered by this Policy. We urge you to review the privacy policy posted on any service you visit before using the service or providing any personal information.

  11. Your Choices. You may request to review, correct, delete or otherwise modify any of the Personal Information that you have previously provided to us. If you have a registered account with us, you may generally update your user settings by logging into the Services with your username and password. To delete your account you may send us an email at hello@opal.community. We may not delete your personal information except by also deleting your user account. We may not accommodate your request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

    If you delete your User Contributions from the Services, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other users.

  12. Children. The Services is not intended for anyone under the age of 18. In particular, Opal does not knowingly collect Personal Information from children under 16. If we learn we have collected or received Personal Information from a child under 16 without verification of parental consent, we will delete that information.   13. Do Not Track Mechanisms. We do not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.

  14. Retention Policy. Opal retains the personal information collected on the Services as long as reasonably necessary to provide the Services, products and information you request, unless a longer retention period is required or permitted by law.

  15. Notice to International Users. We provide the Services for use only by persons located in the United States. If you access the Services outside the United States, you do so on your own risk.

Under California Civil Code Section 1798.83 (known as the “Shine the Light” law), Opal customers who are residents of California may request certain information about our disclosure of personal information during the prior calendar year to third parties for their direct marketing purposes. Opal's Privacy Disclosure for California Residents

This Privacy Disclosure for California Residents describes the rights of California residents under the California Consumer Privacy Act of 2018 (“CCPA”). The CCPA requires us to provide certain information regarding the rights of California residents. The full description of our practices regarding your privacy is provided in our Privacy Policy [www.opal-app.org/privacy-policy].

Please read this Privacy Disclosure for California Residents carefully to understand your rights as a California resident to your information.

  1. We Do Not Sell Your Personal Information. Opal does not sell your personal information. Pursuant to the CCPA, Opal informs you that we do not sell your personal information.

  2. Rights Under the CCPA. The CCPA provides California residents with the following rights.

    (a) Right to Request Your Information. You (or your authorized agent) can request a copy of your personal information. Pursuant to the CCPA, you can also request information on how we have collected, used, and shared your personal information. The right to request information includes the categories of personal information collected and our purpose for the collection, the categories of sources for the information, the categories of third parties with whom the information was shared for a business purpose and our purposes for sharing.

    (b) Right to Opt Out. Opal does not sell personal information so there is no option to opt out of the sale of your information.

    (c) Right to Notification. We cannot collect new categories of personal information or use them for purposes other than those disclosed to you without first notifying you.

    (d) Right to Nondiscrimination. We are prohibited from discriminating against you for exercising your rights under the CCPA. Discrimination, such as denying services, charging different prices or rates for services, providing different levels or quality of services, or suggesting that you receive different levels or quality of services as a result of your exercising of the rights under the CCPA.

    (e) Right to Deletion. You can request that we delete your personal information by terminating your account with us. You can also request that we delete specific information about you. Requests will be granted unless an exception applies, such as when the information is necessary to complete a transaction or contract for which it was collected, necessary to detect, prevent or investigate security incidents, comply with laws, identify and repair bugs, or ensure another user’s ability to exercise their free speech or other rights provided by applicable law.
